Foundational Draft

In an effort to form a more enlightened society this constantly evolving constitution is meant to provide a political structure in the form of an Informed Direct Democracy which will support peace and prosperity for all. At its core are four fundamental principles: Reason, Freedom, Opportunity and Fairness.

Reason: Policies should be guided by evidence, logic and objective analysis. This requires a distinct separation between religion and government.

Freedom: The people should have maximum personal freedoms so long as their behavior does not harm others.

Opportunity: Every person deserves access to the resources needed to build and maintain a meaningful life.

Fairness: Government should protect equal rights, justice and basic human dignity. Reasonable limits shall be placed on the wealth and power of individual entities.

The System recognizes that human understanding is imperfect and that beliefs, policies and institutions should remain open to revision in response to evidence and experience.

Article 1: Nature of The System

The System operates as an Informed Direct Democracy in that ultimate governing authority resides in the hands of the people who can propose policies and vote to change any policy or remove government officials at any time. Regular voting shall occur monthly via an electronic voting system where specific details regarding the subject being voted on are provided. These details are in the form of arguments supporting the proposal, arguments opposing the proposal, and an AI generated statement summarizing the available facts. The Articles of this constitution may be amended at any time by the people.

Article 2: Governmental Structure

The System shall operate through multiple levels of governance intended to address issues at the most appropriate and practical level. Authority shall be distributed among local, regional, national and global institutions in accordance with the principle that decisions should be made as close to the people affected by those decisions as reasonably possible.

The Executive Committee deals with global issues and administers the International Police Force. Decisions of the Executive Committee take precedence over lower governmental entities. Each nation elects one member to the Executive Committee for every 100 million or less in the nation's population.

War is prohibited. The International Police Force is a small military/security force equipped with the latest military and intelligence technology. Its primary purpose is to prevent war and other organized violence by removing the leadership of organizations who start the violence.

The Legislative Branch oversees government operation on National levels. The Legislative Branch has the authority to make laws and fund projects required for government operation, while the people can change those decisions at any time. Regional and Local Branches of government oversee operations at their respective levels.

The Judicial Branch consists of independent courts responsible for interpreting this constitution, resolving disputes and protecting the rights and freedoms guaranteed by The System.

Article 3: Voting and Legislative Process

Any citizen may submit proposals for new policies, changes to existing policies or amendments to this constitution. They may also propose individuals to hold a specific elected office, or propose removing existing officials.

Proposals shall be presented to the people with supporting arguments, opposing arguments and an AI generated summary of the available facts.

A simple majority vote is required for adoption of standard proposals. A 55% majority vote is required for removal of elected officials. A 66% majority vote is required for amendment of this constitution.

The Legislative Branch has the authority to create laws, approve budgets and fund projects required for government operation. The people retain the authority to change those decisions at any time through direct vote.

All votes, government spending and legislative actions shall remain publicly accessible except in matters involving active criminal investigations, intelligence operations or personal privacy rights.

Elections and voting systems shall be designed to maximize transparency, public participation and resistance to corruption or manipulation.

Article 4: Rights and Freedoms

All people are equal under the law and possess the same fundamental rights and protections regardless of race, nationality, sex, religion, wealth, social status or other group affiliation.

The people shall have freedom of speech, freedom of religion, freedom of peaceful assembly and freedom to access and share information.

The people shall have maximum personal freedom so long as their actions do not directly harm others or violate the rights and freedoms protected by this constitution.

No person shall be deprived of their liberty or property without due process of law. The death penalty is abolished.

The people shall have the right to privacy and protection from unreasonable surveillance, search or seizure.

Every person shall have the right to food, shelter, medical care, education and equal opportunity to pursue a meaningful life.

Slavery, torture and cruel punishment are prohibited.

The government shall not establish or favor any religion. Religious belief shall not be used as the basis for law or public policy.

The rights and freedoms protected by this constitution apply equally to all levels of government within The System.

Article 5: Judicial Principles

The Judicial Branch consists of independent courts responsible for interpreting this constitution, resolving disputes and protecting the rights and freedoms guaranteed by The System.

All people are entitled to equal treatment under the law and the presumption of innocence until proven guilty.

Trials shall be fair, public and decided by impartial courts. The accused shall have the right to review evidence, present a defense and receive legal representation.

Laws and penalties shall apply equally to government officials and private citizens.

The purpose of the justice system is to protect society, uphold constitutional rights and rehabilitate offenders whenever reasonably possible.

False imprisonment, political imprisonment and punishment without trial are prohibited.

Judges may be removed from office by vote of the people for corruption, abuse of authority, violation of constitutional principles, or because a 55% majority of citizens in their respective jurisdiction wish to have them removed.

Article 6: Economic Principles

The economic system shall exist to support freedom, opportunity, stability and a reasonable standard of living for all people.

The people shall have the right to own personal property, operate businesses and engage in voluntary trade.

Reasonable limits may be placed on the accumulation of wealth and corporate power when necessary to prevent corruption, exploitation or excessive influence over government and society.

The government may collect taxes required for public services and operation of The System. Taxation shall be structured to distribute the burden fairly according to income and resources. The primary source of government taxation shall consist of an Exchange Tax paid by the receiver in every transaction. This will replace all other taxes other than a wealth tax which would be assessed annually on the ultra rich.

All people shall have access to basic medical care, education, food, shelter and essential public services.

The government shall compete with private enterprise in areas of basic necessity where deemed appropriate, and/or help fund businesses where doing so is expected to enhance the public good.

No government entity is allowed to borrow money but instead the Executive Committee shall create additional fiat currency as needed, and supply necessary funding to lower levels of government while maintaining long-term currency stability.

Government banks will compete with private banks, with an emphasis on providing seed money for innovative business ventures.

The purpose of business is to benefit society by providing useful goods and services while supporting the wellbeing of employees, consumers and the environment. The pursuit of profit shall not justify exploitation, corruption or unnecessary harm to people or the natural world.

Monopolies, fraud, corruption and deliberate economic manipulation harmful to the public are prohibited.

Public resources essential to human survival or public welfare may be regulated or publicly managed when necessary to protect the common good.

Government budgets, expenditures and financial records shall remain publicly accessible.

Article 7: International Relations

The purpose of The System is to promote peace, cooperation and mutual prosperity between nations and peoples.

All nations and populations participating in The System retain the right to preserve their languages, cultures, traditions and local forms of government so long as those practices do not violate the fundamental rights and freedoms protected by this constitution.

The use of war, military aggression and organized violence for political or economic gain is prohibited.

International disputes should be resolved through negotiation, mediation, democratic process and judicial review whenever reasonably possible.

The System shall encourage international cooperation in science, education, environmental protection, disaster response and protection of human rights.

Nations may voluntarily join or withdraw from The System according to procedures established by law.

No nation, corporation or organization shall possess authority above the constitutional rights and democratic authority of the people.

Article 8: Science, Information and Artificial Intelligence

Public access to accurate information is essential to the operation of an Informed Direct Democracy.

Scientific research, education and open discussion shall be encouraged and protected throughout The System.

Artificial intelligence may be used to organize information, summarize arguments, identify misinformation and assist public understanding of complex issues. Artificial intelligence systems shall remain subject to public oversight and may not possess governing authority over the people.

Information systems used by The System shall operate transparently whenever reasonably possible. Deliberate large scale deception intended to manipulate public opinion or democratic outcomes is prohibited.

The people shall have the right to access publicly funded scientific research, government records and information relating to government operation except in matters involving personal privacy rights, active criminal investigations or legitimate security concerns.

Technological advancement should be directed toward improving quality of life, protecting the environment and expanding human knowledge and opportunity.

Article 9: Constitutional Amendment and Evolution

This constitution is intended to evolve over time in response to human knowledge, scientific advancement and the democratic will of the people.

The people retain the authority to amend, remove or add Articles to this constitution through direct vote according to the procedures and voting thresholds established by The System.

No amendment may remove the fundamental principle that ultimate governing authority resides with the people.

All amendments to this constitution shall remain publicly accessible along with the arguments supporting and opposing the amendment and the voting results associated with it.

The purpose of constitutional evolution is to improve freedom, fairness, opportunity, peace and the long term wellbeing of humanity and the natural world.

Article 10: Legislative and Administrative Authority

The Legislative Branch may establish laws, procedures and regulations necessary for operation of The System so long as those laws remain consistent with this constitution.

Operational details regarding elections, taxation, budgeting, law enforcement, judicial procedure, banking, public services and technological standards may be modified through the normal legislative process.

No law, regulation or administrative action may violate the rights and freedoms protected by this constitution or remove the ultimate governing authority of the people.

Additional documents and legislative frameworks may further define the operational details of voting systems, taxation, representation, judicial procedure, artificial intelligence governance, economic policy and other aspects of The System. Such documents shall remain subordinate to this constitution and subject to revision through democratic process.
